Checking I-9 For Remote Workers: What You Need To Know

The federal government requires that all new employees provide documents certifying that they can work legally in the United States. If you are a citizen, you can have a passport, driver’s license, or social security card. Non-citizens must submit documents certifying that they have legally resided in the country and have been granted a work permit.

If an Immigration Customs Board of Directors (ICE) employee appears at your company for auditing (more and more likely these days), Form I-9 verification services must be formally created and stored.

Since 2009, I-9 testing has increased by almost 2,000%. Considering that an average of 68% of forms is incorrect, this is where employers really need to focus. Talent managers can easily create and submit I-9 forms for local employees, but what about I-9 forms for remote staff?

What is the reason for the different remote I-9 tests?

At work today, you can hire employees who live hundreds or thousands of miles away from your home. This poses a real problem for employers who hire remote workers.

The basic steps to fill out the I-9 form remain the same regardless of geographic issues.

  • Part 1 of the form must be completed within the first day of rental.
  • Part 2 must be completed within 3 business days from the rental date.
  • Section 2 must be reviewed and signed by a company representative.

The Department of Homeland Security knows how difficult this is, but it’s not lazy at all. This means that employers need to find a way to perform remote I-9 validation.

Electronic services automate most processes and make them error-free. However, employers need real people in the field through remote recruitment to physically view the document, sign Part 2 and verify its authenticity.

The employer has only three days to verify and verify the authenticity of the new employee’s qualification documents. Since this requires a direct visit, the employer has two main options for reviewing the I-9 document for remote workers.

Please use a notary public.

Who is the I-9 Approval Agent?

Anyone can be an authorized or technically authorized agent. You can also hire an employee representative from a nearby company, hire a lawyer, or hire a librarian in a remote environment.

 

US Citizenship and Immigration Services (USCIS) does not require special qualifications for these authorized agents. The most important thing to remember when finding a certified agent is that you have to be a trusted person. If you fill out and confirm the form incorrectly, you may be subject to huge fines depending on your mistakes.

The law requires that this work be done directly. It is not appropriate for employees to view documents via email or live webcam.

Need to keep a notary?

Many people find it reasonable to notarize the second part of the I-9 form, but it is not.

In fact, taking a notary on this document violates the absolute rules.

Notaries are good at creating government forms, reviewing documents and making responsible choices, but only clarifying responsibilities and signing, not stamps!
